In a resounding assertion of the judiciary's role in safeguarding citizens' rights, Chief Justice of India (CJI) D Y Chandrachud decried arbitrary arrests and threats of unlawful demolitions.
Speaking at an Independence Day event hosted at the Supreme Court premises, he emphasized the importance of citizens finding comfort in the judiciary's voice.
CJI Chandrachud underscored that regardless of case outcomes, the true strength of the judicial system lies in its ability to administer justice. He articulated, "That sense of confidence in an individual that an arbitrary arrest, a threatened demolition if their properties are attached unlawfully, must find solace and a voice in judges of the Supreme Court."
The Chief Justice's remarks held significance against the backdrop of recent incidents in states such as Uttar Pradesh, Madhya Pradesh, and particularly Haryana, where properties belonging to accused individuals, often from minority communities, faced demolition. He acknowledged the role of the judiciary in offering a democratic haven for individuals to seek protection for their lives and liberties.
CJI Chandrachud also received acknowledgement from Prime Minister Narendra Modi for the judiciary's commendable efforts in translating judgments into regional languages, enhancing accessibility for citizens across the country.
Moreover, the CJI expressed his belief in the judiciary's historical role as a bastion of common people's struggles. He emphasized that the judiciary's challenge lies in dismantling barriers to accessing justice and ensuring inclusivity, so that every individual, regardless of their position, can avail of the legal system's protection.
In his address, the Chief Justice emphasized his involvement in addressing grievances. He urged legal practitioners not to seek solutions outside the judicial framework, but rather approach him directly, referring to himself as the "head of the family" to address concerns.
He also advocated for the legal community's conduct to inspire trust in the judicial process, stating, "Judges and lawyers should conduct themselves in a manner that inspires confidence about the independence and integrity of the legal process."
CJI Chandrachud's candid stance echoes the judiciary's commitment to securing the rights and well-being of all citizens, reinforcing the role of the judicial system as a sanctuary for justice seekers, particularly those facing adversities like arbitrary arrests and threats of demolitions.
