Mr. J.S. Virk, the learned Deputy Advocate General assisted by Mr. Rakesh Joshi, the learned Brief Holder for the State of Uttarakhand.

In this appeal, the judgment of conviction under Section 302 of the Indian Penal Code, and sentence of death has been challenged by the appellant, who is a condemned prisoner. The connected Death Reference is REF No. 04 of 2021, in which the learned Senior Counsel Mrs. Pushpa Joshi is representing the condemned prisoner.

There is a delay of 77 days in preferring the present appeal. Keeping in view the fact that the appellant is a condemned prisoner, we, hereby, condone the delay of 77 days in preferring the present appeal. Delay Condonation Application (IA No. 01 of 2021) is, hereby, allowed.
