When learned Senior Counsel for the respondent no. 1 raised objection on the maintainability of this C482 application, learned Counsel for the applicants submitted that he does not press any other prayer except the prayer no. 3 of this C482 application which is regarding consolidation of all criminal cases, under Section 138 of the N.I. Act pending against the applicants, in the light of the proposition of law propounded by the Hon'ble Apex Court in a Suo Moto Writ Petition (Crl.) No. 2 of 2020, reported in AIR 2021 SC 1957.
Learned Senior Counsel does not seriously oppose the above prayer.
Learned State Counsel also does not oppose the said prayer.
Consequently, this C482 application is disposed of with the
observation/direction that the applicants shall move an application for consolidation of the cases and a decision on the same shall be taken expeditiously by the Court below in the light of the judgment of Hon'ble Apex Court (supra).
