JUDGMENT:(per Hon'ble The Chief Justice Sri Raghvendra Singh Chauhan)
Since the sufficient cause has been shown by the
appellant for the delay of 294 days in preferring the present
Special Appeal, the delay is hereby condoned by this Court.
Delay Condonation Application is disposed of.
2. Both the learned counsel are ad idem that this case
is covered by the judgment dated 23.05.2018, passed by a
learned Co-ordinate Bench in Special Appeal No.652 of 2017
and bunch cases.
3. In the said appeals, a similar order had been
challenged before the learned Co-ordinate Bench. By
judgment dated 23.05.2018, the learned Co-ordinate Bench
had remanded the case back to the learned Single Judge.
4. Therefore, even this case is remanded back to the
learned Single Judge.
5. The Special Appeal stands disposed of.
