                        JUDGMENT

1. Mr. T.A. Khan, Senior Counsel appearing for the opposite party has made a statement at the bar that pursuant the order dated 06.03.2019 passed in WPMS No. 587 of 2019, Chief Executive Officer, Uttarakhand Waqf Board appointed District Magistrate, Nainital/Additional Waqf Commissioner, Nainital, as Enquiry Officer under Section 71 of Waqf Act, 1995 with a request to conclude the enquiry and submit the report as early as possible.

2. Since the only direction issued was to Uttarakhand Waqf Board to take decision on petitioner's complaint dated 18.10.2018, therefore, this Court is satisfied that this is not a case of willful disobedience of the order passed by Writ Court.

3. Accordingly, the contempt petition is closed. Notice issued to the opposite party is hereby discharged. However, petitioner shall be at liberty to approach the appropriate forum for expeditious disposal of the enquiry.
