JUDGMENT : (Per Hon'ble Justice Abhinand Kumar Shavili)
When the matter is taken up for hearing, learned
counsel for the respondent has informed the Court
that an identical appeal, viz., Writ Appeal No.838 of
2009, was dismissed by a Division Bench of this
Hon'ble Court vide order dated 18.02.2022, and in
view of the same the present Writ Appeal may be
dismissed.
2. Learned counsel for the appellants has also not
disputed the above fact.
3. In view of submissions made by the parties, this
Court is of the considered view that the present Writ
Appeal also deserves to be dismissed in terms of the
order passed by a Division Bench of this Hon'ble Court
in Writ Appeal No.838 of 2009, dated 18.02.2022, and
the order passed in Writ Appeal No.838 of 2009, dated ::2:: AKS,J & NVSK,J wa_1320_2011
18.02.2022 mutatis mutandis applies to the present
case also.
4. Accordingly, the Writ Appeal is dismissed as
above. No costs.
5. As a sequel, miscellaneous applications pending
if any in this Writ Appeal, shall stand closed.
