         CRIMINAL REVISION CASE No.846 OF 2022

JUDGMENT:

This revision is filed by the petitioner/accused

challenging the Judgment of the XIII Additional District and

Sessions Judge, Ranga Reddy District at L.B.Nagar,

dt.06.12.2019, passed in Criminal Appeal No.1257/2017,

confirming the conviction imposed by the I Special Magistrate,

Hasthinapuram, R.R.District in C.C.No.71 of 2017,

dt.03.11.2017.

2. Heard learned counsel for the revision petitioner and the

learned Additional Public Prosecutor for the respondent-State.

Perused the record.

3. Learned Counsel for the petitioner submits that the

notice for condoning the delay was served on the 2nd

respondent/complainant.

4. The 2nd respondent/complainant is present in person and

accepts receiving notice and also an amount of Rs.1,00,000/-,

which is the entire cheque amount, through D.D.No.002563,

dt.15.12.2022. She further states that she has no further

grievance and does not intend to further prosecute the

petitioner.

5. The offence under Section 138 of the Negotiable

Instrument Act is compoundable and when the parties have

already compromised, this Court deems it appropriate to

consider the said compromise. However, in the present facts,

this Court deems it appropriate to consider the said settlement

in reducing the sentence of imprisonment.

6. Learned Counsel for the petitioner submits that the

petitioner is in Cherlapalli Jail.

7. Accordingly, the Criminal Revision is disposed off

reducing the sentence of imprisonment of the

petitioner/accused to the period already undergone. The

concerned Court shall immediately issue directions for release

of the petitioner.

Miscellaneous Petitions, if any, pending, shall also stand

closed.
