Learned counsel for respondent No. 1 submits that the present

writ petition has become infructuous as the suit in which application

under Order 1 Rule 10 was filed by the petitioner has been finally

decided in favour of the respondent No.1 on 09.07.2025, copy whereof

has been placed on record as Annex-R/1/1. He submits that the order

dated 06.09.2024 (Annexure-5), which is under challenge in the

present petition, was simultaneously assailed by the petitioner by filing

a revision petition before the Board of Revenue and the said revision

petition was also dismissed by the Board of Revenue vide order dated

27.05.2025. He also submits that against the decree and judgment

dated 09.07.2025, the petitioner has preferred Appeal No. 138/25

before the Revenue Appellate Authority, Anoopgarh, District Sri

Ganganagar, a copy whereof has been placed on record as Annexure-R/

1/4. Learned counsel for the respondent No.1 further submits that the

petitioner has not approached this Court with clean hands, as he has

challenged the impugned order simultaneously by filing the present writ

petition before this Court as well as a revision petition before the Board

of Revenue.

Learned counsel for the petitioner is not in a position to refute the

submissions made by learned counsel for the respondents.

In view of the above submissions made, the writ petition is

dismissed as having become infructuous.
