1. The instant application under Section 430 BNSS (old section

389 Cr.P.C.) seeking temporary suspension of sentence has been

preferred on behalf of the appellant-applicant, who has been

convicted by the learned Special Judge, NDPS Cases, Pratapgarh

vide judgment dated 29.09.2025 passed in Sessions Case

No.28/2019 for the offences under Sections 8/15 and 8/25 of the

NDPS Act with punishment of rigorous imprisonment of 7 years.

2. Learned counsel for the appellant submits that the marriages

of Kamla Shankar @ Kamlesh, son of the appellant is scheduled to

be solemnized on 04.12.2025 and the pre-marriage rituals are to

commence from 24.11.2025. It is further submitted that as the

appellant is the father of the groom, his presence is essential for

performing the associated social obligations. A copy of the

wedding invitation card has been annexed with the bail

application.

3. Learned Public Prosecutor has verified the fact that the

marriage is indeed scheduled to be held on 04.12.2025.

4. I have heard the learned counsel for the appellant-applicant

and the learned Public Prosecutor and gone through the material

available on record.

5. Considering the submissions made by the learned counsel for

the appellant-applicant and taking a humanitarian view of the

matter, this court is inclined to grant temporary bail of 11 days to

the appellant-applicant.

6. Accordingly, the instant application for temporary suspension

of sentence is allowed. The sentence awarded to appellant-

applicant Kanhaiya Lal S/o Mangi Lal by learned Special Judge,

NDPS Act Cases, Pratapgarh in Sessions Case No.28/2019 vide

judgment dated 29.09.2025 shall remain suspended for a period

of 9 days from 27.11.2025 upon his furnishing a personal bond in

the sum of Rs.50,000/- and two sound and solvent sureties of

Rs.25,000/- each to the satisfaction of the trial court. The

appellant-applicant shall surrender before the District Jail,

Pratapgarh in the morning of the next day of completion of the

period of temporary bail i.e. 06.12.2025.
