1. Heard learned counsel for the parties.
2. Learned counsel for the petitioners submits that the
controversy involved in the present case is squarely covered by a
[2025:RJ-JD:29076] (4 of 4) [CW-12802/2025]
judgment dated 21.05.2025 rendered by this Court in S.B. Civil
Writ Petition No.18889/2024 (Dr. Jwala Prasad Kaloshia
Vs. State of Rajasthan & Ors.) in the following terms:-
"12. In view of the discussions made above, the present
writ petitions are disposed of with a direction to the
respondent-State Government to extend the benefits of
Rules of 2023 to those persons, who are engaged on the
posts that are covered under the Rules of 2023 and are
serving in colleges falling within the ambit of the
Rajasthan College Education Society.
13. It is made clear that the petitioners, serving in the
Colleges which are coming within the ambit of Rajasthan
College Education Society (Raj-CES), shall not be
disengaged till the process under the Rules of 2023 is
initiated afresh.
14. Stay petition and other pending application(s), if
any, also stand disposed of accordingly."
3. Learned counsel for the respondents is not in a position to
refute the submissions made by learned counsel for the
petitioners. However, he prays that liberty may be granted to the
respondents to pass a speaking order in cases of those petitioners
whose cases are not covered by the judgment rendered in case of
Dr. Jwala Prasad Kaloshia (supra).
4. In view of the discussion made above, the present writ
petition is disposed of in terms of the judgment rendered by this
Court in the case of Dr. Jwala Prasad Kaloshia (supra). Further, a
liberty is granted to the respondents to pass a speaking order in
those cases which are not covered by the case of Dr. Jwala Prasad
Kaloshia (supra).
