            HON'BLE MR. JUSTICE VINIT KUMAR MATHUR

Order

03/07/2025

1. Heard learned counsel for the parties.

2. The present writ petition has been filed for the following

reliefs:-

"(i). Action of the respondents by which they are not allowing petitioners to give preference on their posts of college lecturers under Vidya Sambal Yojana in respective colleges in respective subject may kindly be held illegal and arbitrary.

(ii). By appropriate writ of direction the respondents may kindly be directed to give preference to the petitioners on the post of college lecturer under Vidya Sambal Yojna in respective colleges in respective subject for next academic session 2025-2026/next academic semester and further academic sessions/semesters and also directed to respondents not to terminate services of petitioners till availability of vacant post in any Govt. College in state of Rajasthan in subject of petitioners.

(iii). By an appropriate writ, order or direction, the respondents be directed to implement the directions passed vide order dated 28.08.2023 in the leading case No. S.B. C.W.P. No.1474/2023 titled Ram Chaturvedi & Ors. Vs. State of Rajasthan & Ors. (Annex.5) along with connected matters, till the Vidhya Sambal Scheme is in operation."

3. However, learned counsel for the petitioners submits that the

petitioners will be satisfied if a liberty is granted to them to file an

appropriate representation before the respondent-authorities for

redressal of their grievances and the respondents may be directed

to decide the same in accordance with law while keeping in mind

the judgments rendered by this Court as well as circulars issued

by the respondents.

4. Learned counsel for the respondents submits that in case

such representation is filed, the same shall be considered and

decided by keeping in mind the circulars dated 17.11.2021,

26.07.2024, 18.03.2025, 20.03.2025 & 28.04.2025 issued by the

respondents expeditiously.

5. In view of the submissions made before this Court, the

present writ petition is disposed of with a liberty to the petitioners

to file an appropriate representation before the respondents for

redressal of their grievances and in case such representation is

filed, the respondents are directed to decide the same while

keeping in mind the judgments rendered by this Court as well as

circulars issued by the respondents at the earliest, preferably

within a period of four weeks from the date of receipt of such

representation, strictly in accordance with law.
