Order
26/09/2024
1. Petitioners seek quashing of criminal proceedings in Criminal
Case No.555/2021 pending before the learned Additional Chief
Judicial Magistrate, Padampur, Sriganganagar arising out of FIR
No.232/2019, dated 06.11.2019, registered at P.S. Padampur,
Sriganganagar for the offence punishable under Sections 419,
420, 467, 468, 471 & 120-B of IPC on the basis of compromise
arrived between the parties.
2. Learned counsel for the petitioners submits that during the
pendency of the criminal case, the petitioners and the respondent
No.2-complainant have entered in a written compromise. An
(2 of 2) [CRLMP-5787/2024]
application for the compromise was filed by the respondent No.2 -
complainant before the learned trial Court, which was dismissed
vide order dated 03.09.2024 by the learned trial court.
3. On a Court query, learned counsel for the respondent No.2 -
complainant apprises that pursuant to the mutual settlement
arrived between the parties, the respondent No.2 - complainant
does not want to press the charges against the petitioners.
4. It is borne out from the order dated 03.09.2024 passed by
the learned trial Court that compromise has indeed been arrived.
The genuineness thereof is not in dispute. In the premise, in the
larger interest of justice, invoking inherent powers vested with
this Court under Section 482 Cr.P.C. it is deemed expedient to
quash the criminal proceedings in question arising out of a dispute
between the parties for mutual good relations between the parties
and to maintain societal peace. Reference in this context may be
had to judgment rendered in the case of Gian Singh Vs. State of
Punjab & Anr. [(2012) 10 SCC 303].
5. Consequently, the instant petition is allowed. The criminal
proceedings in Criminal Case No.555/2021 pending before the
learned Additional Chief Judicial Magistrate, Padampur,
Sriganganagar arising out of FIR No.232/2019, dated 06.11.2019,
registered at P.S. Padampur, Sriganganagar, are hereby quashed.
6. All pending application(s), if any, shall also stand disposed of.
