Learned counsel for the respondent submits that the Civil

Appeal No.1924/2014 preferred by the appellate corporation

involving identical controversy has been dismissed by the Hon'ble

Supreme Court of India vide judgment dated 20.08.2014. He,

therefore, prays for dismissal of the civil second appeal.

Learned counsel for the appellants, in all fairness, did not

dispute the aforesaid statement.

In view thereof, this civil second appeal is also dismissed.

The pending application also stands disposed of.
