1. Learned counsel for the petitioners submitted that the
petitioners would be satisfied if the respondents are directed to
consider their representation which they would be filing (within
[2023:RJ-JD:36929] (2 of 2) [CW-11935/2017]
four weeks) in light of the judgment passed by the Hon'ble Apex
Court in the case of State of Punjab & Ors. Vs. Jagjit Singh &
Ors.; reported in (2017) 1 SCC 148.
2. Mr. Chayan Bothra, learned counsel for the respondent-Bank
submitted that in light of the judgment dated 28.11.2018,
rendered by a Disivion Bench of this Court in the case of State
Bank of India & Ors. Vs. Ashish Kumar & Ors.; D.B. Spl.
Appl. Writ No.1063/2018, the petitioners are not entitled for
any relief.
3. Be that as it may.
4. At the request of the petitioners, the present writ petition is
disposed of with a direction to the petitioners to file a
representation alongwith with the copy of the order instant within
a period of four weeks.
5. In case the representation is so addressed, the Competent
Authority of the respondent-Bank shall consider the same in
accordance with law, including the judgment of Hon'ble the
Supreme Court, passed in the case of Jagjit Singh (supra) and this
Court passed in State Bank of India Vs. Ashish Kumar (supra).
6. The present writ petition so also the stay petition stand
disposed of.
