Heard.

Though the learned counsel for the State seeks to challenge

the correctness and validity of the order passed by the learned

Single Judge in S.B. Civil Writ Petition No.14038/2017, we find

that the learned Single Judge proceeded to pass the order on the

basis of consent of the parties that the case in hand is covered by

[2023/RJJD/006529] (2 of 2) [SAW-372/2021]

the judgment rendered in the case of Mahesh Chandra Boda Vs.

State of Rajasthan & Ors. (SBCWP NO.10834/2017).

As the order passed by the learned Single Judge proceeds on

consent of the parties, we are not inclined to entertain this appeal.

The appeal is, therefore, dismissed. However, the State is

granted liberty to apply for review/recall of the impugned order, if

so advised.
