Heard.

It is submitted by the counsel for the petitioner that

summons were issued by registered post only and that the same

were not served on the proprietor of the firm, and that the decree

has been passed without even issuing summons for judgment.

In view of submissions made, issue notice. Issue notice of

stay petition as well. Notices are made returnable within four

weeks.

Notices when issued, be given 'Dasti' to the counsel for the

petitioner for service upon the respondent.

In the meanwhile and till further orders, execution of the

decree dated 19.04.2021 passed in N.C.V. No.20/2021 by the

Commercial Court, Jodhpur shall remain stayed.

Call for record of N.C.V. Case No.20/2021 decided on

19.04.2021 by the Commercial Court, Jodhpur. Requisition when

issued, be given 'Dasti' to the counsel for the petitioner.
