It is stated that a jail appeal was also filed by appellant-

Kishan, which was registered as D.B. Criminal Appeal (D)

No.320/2022 and on the request of the Court, Mr. Rajesh Kumar

Sharma appears as Amicus Curiae.

Subsequently, appellant-Kishan got another appeal filed by

engaging a counsel which was registered as D.B. Criminal Appeal

(D) No.372/2022.

As the judgment of the conviction and sentence has already

been challenged in D.B. Criminal Appeal (D) No.320/2022 too, the

subsequent appeal, i.e., D.B. Criminal Appeal (D) No.372/2022

challenging the same judgment of conviction and sentence need

not continue and is disposed off. Learned counsel, who filed D.B.

Criminal Appeal (D) No.372/2022 is permitted to appear for the

appellant in D.B. Criminal Appeal (D) No.320/2022 and take all

necessary steps in the matter including prayer for Suspension of

Sentence.
