Learned counsel for the appellant submits that during the

pendency of appeal, appellant and respondent Nos.1 and 4 had

arrived into a compromise but learned appellate court did not

mention the factum of compromise in its impugned judgment

dated 23.08.2022.

Issue notice to the respondents of the appeal to show cause

as to why this second appeal be not admitted on the substantial

questions of law, as framed in the memo of appeal.

Issue notice to the respondents of the stay application also.

List after four weeks.

In the meanwhile, both the parties shall maintain status quo,

as exist today, over the suit property.
