1. Petitioner has filed this second bail application under Section

439 Cr.P.C.

2. F.I.R. No.416/2018 was registered at Police Station Railway

Colony, District Kota City for offence under Sections 302 & 34

I.P.C.

3. It is contended by counsel for the petitioner that petitioner is

aged seventy three years. It is also contended that DNA of the

body which was recovered, is not matching. It is also contended

that out of thirty two witnesses, only seven witnesses have been

examined. Petitioner has remained in custody for a period of about

four years.

4. Learned Public Prosecutor has opposed the second bail

application.

5. I have considered the contentions and have perused the

record.

6. From perusal of the record, it is clear that as many as thirty

eight cases are registered against the present petitioner, including

the case under Section 302 of IPC wherein petitioner has been

sentenced to life imprisonment, hence I am not inclined to

entertain the second bail application.

7. Accordingly, present Criminal Misc. Second Bail Application is

dismissed.

8. However, taking note of the fact that petitioner has remained

in custody for about four years, trial Court is directed to expedite

the disposal of the case.
