This writ petition has been filed by the petitioner, inter-alia,

seeking similar directions as given in Sonam Sharma vs. State of

Rajasthan & Anr. : S.B. Civil Writ Petition No.12121/2021 decided

on 04.09.2021 (Annex.3), wherein a Coordinate Bench of this

Court, permitted withdrawal of the writ petition with liberty to file

representation before the competent authority to consider

petitioner's candidature also in the light of judgment in

Namonarayan Sharma vs. State of Rajasthan & Ors. : D.B.S.A.W.

No.908/2017 decided on 08.01.2020.

A perusal of the order passed in the case of Namonarayan

Sharma (supra) reveals that the order is not confined to the

petitioners therein; and once the directions given therein are

implemented, the petitioner, if eligible would also be governed by

the same order. There is no reason for passing the same orders all

over again and requiring the petitioner to approach the

respondents in this regard.

It is informed by the counsel for the petitioner that the order

in the case of Namonarayan Sharma (supra) passed by Division

Bench is pending consideration before the Hon'ble Supreme Court,

wherein there is an interim order.

In view of above fact situation, no case for passing of any

additional direction is made out in the petition. As already

observed, the directions issued in the case of Namonarayan

Sharma (supra) have already been given and as and when the

same is implemented, and in case the petitioner would fall in the

said criteria, he would be entitled to get the benefit thereof.

With the observations, the writ petition stands disposed of.
