Order
29/11/2022 Counsel for appellant-plaintiff submits that the suit for
specific performance was filed in respect of 1/6 share of the
agricultural land for which respondent No.1 to 3 agreed to sell in
favour of plaintiff, however has executed registered sale deed in
favour of respondent No.4. he submits that for remaining land,
appellant-plaintiff is Khatedar as per revenue record of Jamabandi.
Learned counsel for appellant submits that respondent No.4
though did not get any possession under the sale deed, however
inclined to enter into the possession during the course of this first
appeal, after dismissal of the suit vide impugned judgment and
decree dated 19.02.2021.
Heard.
Admit.
Issue notice to respondents by both modes, ordinary process
as well as registered post.

In the meanwhile, both parties shall maintain status quo in
respect of 1/6 portion of the land in question, which is subject
matter in dispute in the present appeal.
In view of above, application for early listing stands disposed
of.
