SB Civil First Appeal No. 458/2006 is tenant's appeal against

the judgment and decree of ejectment passed in civil Suit No.

301/2002. The appeal was dismissed for non-prosecution on

04.07.2022 as none appeared on behalf of the appellant.

Learned counsel for the appellant submits that the arrears of

rent in pursuance of order dated 19.11.2016 has already been

deposited. For substantial justice, dismissal is set aside subject to

payment of Rs. 20,000/- payable to respondents. It is directed

that appeal be restored to its original number, costs be deposited

within two weeks.

The restoration application is accordingly allowed.
