Appellant has challenged the judgment and decree dated
04.08.2022 passed by Additional District Judge, Nainwa, District
Bundi in first appeal No.61/2021 (CIS No.61/2021) whereby and
whereunder damages to the tune of Rs.15000/- has been awarded
in favour of respondent-plaintiff and against the appellant.
Counsel for appellant admits that as per Section 102 of CPC,
the second appeal is not maintainable and he prays to convert this
appeal into revision petition.
Prayer is allowed.
Office may convert this appeal into revision petition.
Learned counsel for petitioner undertakes to do the needful
within a period of three weeks.
