Although, the matter comes up on an application (1/2022)
filed by the respondents seeking vacation of ex-parte interim
order dated 07.04.2022; but, on the request of the learned
counsels for the respective parties, the writ petition was heard on
its merit.
Learned counsels for the respective parties submit that this
writ petition wherein, validity of the order dated 07.03.2022
placing the petitioner under suspension is under challenge, may
be disposed of in terms of direction issued by a co-ordinate Bench
(2 of 2) [CW-4779/2022]
of this Court vide order dated 10.03.2022 in SBCWP
No.13615/2021; Vishnu Kumar Sharma Vs. State of Rajasthan &
Ors.
In case of Vishnu Kumar Sharma (supra) following
directions were issued by this Court:
"3. In view of the judgment passed by the Hon'ble Supreme Court in the matter of Ajay Kumar Choudhary Vs. Union of India (supra) and in view of Rule 13(5) of the Rajasthan Civil Services (Classification, Control & Appeal) Rules, 1958, I deem it just and proper to direct the respondents to consider the case of the petitioner for revocation of suspension within a period of 60 days by passing a speaking and reasoned order strictly in accordance with law. However, the petitioner is at liberty to file fresh writ petition if need so arises.
4. Ordered accordingly. The writ petition is disposed of. The stay application, if any, also stands disposed of.
5. Interim order shall continue till disposal of the matter by the respondents. All the pending applications stand disposed of."
Taking into consideration the contentions advanced by learned
counsels for the respective parties, this writ petition is disposed of in
terms of direction issued by this Court in case of Vishnu Kumar
Sharma (supra) which shall apply mutatis mutandis to this case
also.
The pending applications also stand disposed of accordingly.
