HON'BLE MR. JUSTICE FARJAND ALI
Order
29/11/2022
By way of filing the instant revision petition, petitioner has
challenged the legality, correctness and propriety of the judgment
of conviction dated 04.03.2017 passed by the learned Additional
Chief Judicial Magistrate, Sri Karanpur in Criminal Regular Case
no.213/2010 as well as the judgment of Appellate Court passed by
learned Additional Sessions Judge, Sri Karanpur in Criminal Appeal
No.02/2019 (CIS No.02/2019) before this Court.
After rigorous trial, the accused respondent was acquitted
from the charges leveled against him. Aggrieved by the judgment
of acquittal, the complainant has preferred the appeal wherein
after hearing the parties and considering the legal and factual
aspects of the matter, the learned Appellate court has confirmed
the judgment of acquittal. There are concurrent findings of two
Courts below with sound reasoning, thus, there seems no
(2 of 2) [CRLR-402/2022]
justification to interfere in the judgment passed by the Courts
below.
Accordingly, the instant revision petition filed under Section
379/401 of Cr.P.C. is dismissed.
