By way of this criminal miscellaneous petition,

petitioner wants to challenge the order dated 15.02.2022 passed

by learned Sessions Judge, Sawai Madhopur (learned Sessions

Judge) in which learned Sessions Judge has imposed the condition

to deposit of compounding fees within four weeks.

Learned counsel for the petitioner submits that the

petitioner has deposited NGT fees as well as the Mineral fees.

Learned counsel for the petitioner further submits that the

petitioner wants to contest the case. So, condition imposed by the

learned Sessions Judge for depositing the compounding fees be

deleted.

Learned counsel for the petitioner has placed reliance

upon the judgment passed by this Court in S. B. Criminal

Miscellaneous Petition No. 1161/2020 titled as Jitendra

(2 of 2) [CRLMP-2562/2022]

Meena Versus State Of Rajasthan & Anr. and other connected

matters.

Learned Public Prosecutor has opposed the arguments

advanced by learned counsel for the petitioner and submitted that

the petition filed by the petitioner be dismissed.

As per contention of learned counsel for the petitioner

that the petitioner has deposited the fees of NGT as well as

Mineral Fees and the petitioner wants to contest the case. So,

learned Sessions Judge wrongly ordered for depositing the

compounding fees. So, order for compounding fees is deleted from

the order of learned Sessions Judge.

Hence, this Criminal Miscellaneous Petition stands

disposed of.

Stay application also stands disposed of accordingly.
