The appellant-defendant has preferred this first appeal
against the judgment and decree dated 05.12.2020 passed by
Additional District and Sessions Judge No.1, Alwar whereby the
respondent-plaintiff's suit for recovery of money amounting
Rs.1,53,910/- with interest @6% per annum w.e.f. 20.07.2013
has been decreed.
Heard.
Admit.
Issue notice to respondents of appeal as well as stay
application.
Call for the record.
In the meanwhile, if appellant deposits Rs.1,00,000/- before
the trial court within a period of four weeks, the execution of
impugned decree shall remain stayed. On deposition of such
amount, the same be disbursed to respondent-decree holder on
furnishing an undertaking that in case the appellant succeeds in
appeal, he shall restitute the amount received by him.
