Learned counsel for the petitioner submits that the petitioner

borrowed Rs. 4 lakhs from the respondent-Bank in the year 2016.

On account of financial crisis and COVID reasons, he could not

repay whole amount and able to pay only Rs. 3,94,000/- in

installments. Now, the property mortgage by him with the bank is

going to be auctioned by the bank today itself as the respondent-

Bank is demanding more than Rs. 4 lakhs, which is excessive

amount. He further submits that the petitioner is ready to settle

the amount with the respondent-Bank and is also ready to pay

Rs. 2 lakhs today itself.

Issue notice. Issue notice of the stay application also,

returnable on 13.07.2022.

Meantime and till next date, if petitioner deposits Rs. 2 lakhs

with the respondent-Bank as provisional amount today itself,

auction of the property in question shall remained stayed.

The petitioner shall file a representation regarding balance

outstanding amount before the respondent - bank, which shall be

considered in accordance with law.

List the matter on 13.07.2022.
