Judgment
28/06/2022
1. No one has put in appearance on behalf of appellant.
2. From the perusal of record, it appears that parties entered
into compromise in Civil Suit No.62/1995 and on the basis of
compromise, a decree dated 31.07.1997 was passed. Thereafter,
appellant challenged the compromise decree by way of filing a civil
suit. The trial court vide impugned judgment dated 18.01.2020
dismissed the civil suit as not maintainable, with liberty to move
an application before the court concerned, who passed the
compromise decree, if appellant feels aggrieved by the
compromise decree dated 31.07.1997.
3. The appeal was listed on 13.05.2022 before the co-ordinate
bench of the Rajasthan High Court, Jaipur Bench but no one
appeared then again this appeal listed on 27.06.2022 before this
Court but again no one appeared. Today also no one has put in
appearance on behalf of appellant to pursue the first appeal.
4. In the aforesaid facts and circumstances, the first appeal is
dismissed for non-prosecution.
