Petitioner has challenged the judgment dated

123.05.2022 passed by Sessions Judge, Dholpur while dismissing

the criminal appeal No.54/2018 and maintaining the judgment of

conviction and sentence dated 02.11.2018 passed by Judicial

Magistrate No.3, Dholpur in Regular Criminal Case No.312/2017

and has been convicted and sentenced for offence under Sections

411 IPC. Alongwith the appeal, the appellant has filed this

application for suspension of sentence.

Heard learned counsel for the accused-appellant as well

as learned Public Prosecutor and perused the material available on

record.

Counsel for the petitioner submits that petitioner is

ready to deposit the fine amount.

Considering the fact that disposal of appeal will take

time and considering the facts and circumstances of the case, this

Court deems just and proper to suspend the sentence awarded to

the accused-petitioner.

Accordingly, if petitioner deposits the fine amount

awarded by the court below, the application for suspension of

sentence is allowed and it is ordered that the sentence passed by

court/s below against the accused-petitioner Virendra S/o Shri

Ramdayal shall remain suspended, provided he execute a

personal bond in the sum of Rs.50,000/- along with two sureties

in the like amount each to the satisfaction of the trial court for his

appearance in this court on 22.07.2022 and as and when called

upon to do so.
