It is submitted by leaned counsel for the petitioner with reference to judgment in Shravan Kumar Bidiyasar v. Ajmer Vidhyut Vitran Nigam Ltd. & Ors.: S.B. Civil Writ Petition No.2297/2014, decided on 16.7.2015 that a mere mechanical reference to the pendency of investigation or trial in a criminal case against the employee would not sub-serve the purpose of Regulation 9 of RSEB Employees Classification, Control & Appeal Regulations, 1962 and that in the present case only on account of registration of FIR against the petitioner, he has been placed under suspension.

In view of the submissions made, issue notice. Issue notice of the stay application also, returnable within four weeks.

Notices when issued be given 'dasti' to learned counsel for the petitioner.

In the meanwhile and till further orders, effect and operation of the order dated 13.7.2022 (Annex.3), shall remain stayed.
