Heard learned counsel for the appellant, learned Public

Prosecutor and perused the material available on record.

The appellant has been convicted vide judgment dated

15.01.2019 passed by learned Addl. Sessions Judge No.1, Barmer

in Sessions Case No.38/2017 (30/2016) for the murder of Bakhta

Ram. There are specific allegation of the eyewitnesses that the

appellant inflicted fatal axe blows to Bakhta Ram. As many as five

injuries were noticed by the doctor when postmortem was carried

out.

In this background, looking to the nature and gravity of

allegations, we are not inclined to accept the instant second

application for suspension of sentences, which is dismissed as

being devoid of merit. The appeal shall be listed for hearing in the

appropriate order of priority.
