1. Mr. Sharma, learned counsel for the petitioner argues that
the learned Additional Sessions Judge, Merta has committed grave
error of law in taking cognizance against the petitioner without
affording opportunity of hearing to him.
2. In support of his contention aforesaid, learned counsel for
the petitioner relies upon the judgment of this Court dated
17.09.2017, rendered in the case of Jamna Singh & Anr. Vs.
State of Rajasthan & Anr. reported in [2007] Supreme (Raj.)
1224.
3. Issue notice to the respondents. Issue notice of stay
application also, returnable without six weeks.

4. Meanwhile, proceedings pending before the trial Court in
pursuant to order dated 25.05.2022 passed by the Appellate
Court qua the petitioner shall remain stayed.
