After attempting to argue the matter on merits for quite

some time, learned counsel for the petitioner has submitted that

he does not want to press this writ petition, however, seeks liberty

for the petitioner to avail statutory remedy of appeal/revision as

provided under the Rajasthan Minor Mineral Concession Rules,

2017.

Accordingly, the writ petition is dismissed as not pressed with

the liberty sought for.

However, if any appeal/revision is filed by the petitioner

before the appellate/revisional authority within a period of two

weeks from today alongwith the application under Section 5 of the

Limitation Act, it is expected that the appellate/revisional

authority shall consider the said application sympathetically and

thereafter decide the appeal/revision on merits as far as it is

possible.
