Appellant-defendant No.1 has preferred this first appeal

feeling aggrieved by the impugned judgment and decree dated

11.03.2022 passed by Additional District Judge, Fatehpur, Sikar in

Civil Appeal No.259/2013 (BIT No.02/2016) CIS No.02/2016

whereby and whereunder the sale deed dated 07.08.2008 has

been declared as null and void in relation to the roof of the shop in

question.

Heard.

Admit.

Issue notice.

In the meanwhile, both parties shall maintain status quo in

relation to the roof of the shop in question.

Learned counsel for the appellant-defendant submits that the

contesting party is only respondent-plaintiff No.1 and respondents

No. 2 to 7 are proforma respondents and they were co-defendants

with the appellant and they have no interest in the present appeal,

hence on the request of learned counsel for the appellant, service

of respondent Nos.2 to 7 is dispensed with.
