By way of this first appeal, appellant-defendant No.1 has

assailed the judgment and preliminary decree for partition dated

20.04.2022 passed by Additional District Judge No.3, Jaipur

Metropolitan-I, Jaipur in Civil Suit No.04/2013 (CIS No.737/2014).

Call for the record

Learned counsel for appellant submits that parties are in

joint possession of suit property.

In view of that, appellant shall not be dispossessed from the

portion of property in his possession during the course of this

appeal and no third party right would be created by either of the

parties.
