Learned counsel for the petitioners submits that in view of

conflicting views of the Co-ordinate Benches of this Court as to

jurisdiction of the Maintenance Tribunal to order for eviction under

the Maintenance and Welfare of Parents and Senior Citizens Act,

2007, a reference is pending consideration before a Division

Bench of this Court.

Counsel for the respondent-caveator did not dispute the

aforesaid position.

In view thereof, the operation and execution of the judgment

dated 13.04.2022 passed by the Court of Sub Divisional Officer,

Jaipur-II (Sanganer) Jaipur in complaint No. 42/2021 shall remain

stayed till further orders.
