Learned counsel for the petitioner submits that instead of assailing the judgment of conviction before the Division Bench, the appeal has been filed before this Court. However, he seeks permission to withdraw the above mentioned appeal.

Hence, the present criminal appeal is hereby dismissed as withdrawn with liberty to file a fresh appeal before the Division Bench.

It is directed that the certified copies of the order dated 27.04.2022 passed by learned Special Judge, POCSO Act Cases, Churu shall be returned back to the counsel upon furnishing the legible xerox copies of the same.

The application (Inward No.02/2022) for treating the S.B. Criminal Appeal as D.B. Criminal Appeal stands disposed of.

This instant appeal as well as instant application for suspension of sentence is disposed of in above terms.
