It is submitted by learned counsel for the petitioner that the

petitioner is due to retire on 30.05.2024 and he has been

transferred from Bhilwara to Bikaner, which action of the petitioner

is contrary to the judgment in the case of Dr. (Smt.) Pushpa

Mehta v. Rajasthan Civil Services Appellate Tribunal &

Ors. : D.B. Special Appeal (Writ) No.11538/1999, decided on

16.12.1999.

Further submissions have been made that the petitioner has

not been relieved yet and no one has been posted in place of the

petitioner.

In view of the submissions made, issue notice. Issue notice

of the stay application also, returnable on 22.09.2022.

Notices when issued be given 'dasti' to counsel for the

petitioner.

In the meanwhile and until further orders, the effect and

operation of the order dated 28.07.2022 (Annex.3) qua the

petitioner, shall remain stayed.
