Heard learned counsel for the appellant on admission.

While relying upon the judgment of the Hon'ble Supreme

Court rendered in the case of Ningamma & Anr. vs. United

India Insurance Co. Ltd. reported in (2009) 13 SCC 710,

learned counsel for the appellant submits that the deceased

comes in the shoes of registered owner and cannot claim

compensation under the provisions of Section 163-A of the Motor

Vehicles Act.

Admit.

Issue notice of appeal as well as stay application.

Meanwhile and till next order, if appellant deposits the

additional amount of Rs. 1 lac without interest against impugned

Award dated 07.01.2022 passed by the Judge, Motor Accident

Claims Tribunal, Deedwana, District Nagaur in Claim Petition

No. 59/2012 (Saroj & Ors. vs. Praveen Kumar & Ors.) within a

period of six weeks from today, execution of rest of the amount

qua appellant shall remain stayed.

On depositing the said amount, the tribunal shall disburse

the same in terms of the award impugned.
