Heard on admission.

Learned counsel for the appellant would submit that the writ

petition was allowed by learned Single Judge relying upon Division

Bench judgment of this Court in "State of Rajasthan & Ors. Vs.

Jabra Ram (D.B. Civil Special Appeal No.141/2004) and other

judgment in "Shah Goverdhan Lal Kabra Teachers College Verus

Union of India (D.B. Civil Writ Petition No.1644/1999) and on facts

also the case of the writ petitioner was similar to those in whose

favour order was passed by Division Bench of this Court.

Learned counsel for the appellant would further submit that

the petitioner-respondent could not claim benefit of the degree

(2 of 2) [SAW-261/2021]

which were obtained through correspondence from University

except Kota University of the State of Rajasthan in view of what

has been stated in order dated 14.11.2019, Annexure R/1

annexed with the reply to the writ petition and Rule 274 (1) (ii) of

Rajasthan Rules, 1996.

Having considered submissions of learned counsel for the

parties particularly taking into consideration the order passed by

the Division Bench of this Court in the cases which have been

referred to by learned Single Judge, in our view the order passed

by learned Single Judge does not warrant any interference.

Appeal is dismissed at admission stage.
