1. Petitioner has filed this bail application under Section 439

Cr.P.C.

2. F.I.R. No.19/2020 was registered at Police Station Sarthal,

Distt. Baran for offence under Sections 8 & 15 of NDPS Act.

3. It is contended by counsel for the petitioner that petitioner

was the passenger in the vehicle. He had nothing to do with the

recovered contraband. He was not in conscious possession of

contraband.

4. Learned Public Prosecutor has opposed the bail application.

It is contended that petitioner tried to run from the vehicle and he

was caught from the spot. From the vehicle, 2 quintals and 65 kgs

of poppy husk has been recovered.

5. I have considered the contentions.

6. Considering the contentions put forth by counsel for the

State, I am not inclined to entertain the bail application.

7. This bail application is, accordingly, dismissed.
