1. Prayer in the petition is for initiating proceedings against the

respondent for intentional and willful defiance of judgment, Annexure

P/1 dated 26.10.2021 and order Annexure P/3 dated 17.02.2021, in

CRM-M-45677-2019.

2. A perusal of judgment / order Annexures P/1 and P/3

reveals that the petition for pre-arrest bail filed by the respondent was

allowed by taking into account the statement of learned counsel for the

respondent that FIR being outcome of a monetary dispute between the

parties had been compromised and the respondent had paid a sum of

Rs.13,00,000/- and only interest remained outstanding which the

respondent would pay to the petitioner (complainant) within three

months.

3. At the outset, learned counsel for the petitioner contends that

pursuant to the issuance of notice, the respondent has made payment to

the petitioner in terms of Annexure P/1 and P/3, therefore, the petitioner 1 of 2

COCP-429-2022 [2]

is not interested in pursuing the instant petition and may be permitted to

withdraw the same.

4. In view of the position noted above, as well as statement of

learned counsel for the petitioner, the instant petition is disposed of as not

calling for any action against the respondent, under the Contempt of

Courts Act, 1971.
