The petitioner has approached this Court seeking grant of

anticipatory bail in respect of a case registered vide FIR No.32 dated

28.6.2012 at Police Station Joga, District Mansa under Sections 457 and 380

of Indian Penal Code.

The petitioner had infact earlier been granted bail in the

aforesaid matter but subsequently on account of his absence before the Trial

Court, his bail was cancelled on 11.6.2018. Apprehending his arrest, the

petitioner moved an application for grant of anticipatory bail before the Trial

Court, which was declined on 13.11.2019.

The conduct of the petitioner has been noticed in para No.4 of

order dated 13.11.2019 passed by learned Additional Sessions Judge, Mansa,

which reads as follows:

"4. Trial Court record shows that this applicant is a frequent absentee. He remained absent from the proceedings unauthorizedly between 18.12.2015 and 25.10.2016 and then from 29.11.2017 till now. Meanwhile his bail order and bail bonds were cancelled on 11.6.2018.. He is being summoned through non-bailable warrants by the concerned trial Court continuously. There is nothing on record reflecting that applicant had any stomach problem."

The aforesaid conduct would not warrant any ground to grant

anticipatory bail particularly in view of judgment passed by this Court in

CRM-M-39172 of 2021 titled Pawan Kumar Vs. State of Haryana and

another decided on 21.9.2021. The petition, as such, is dismissed.
