Date : 02-01-2023 Heard Mr. Najmul Hodda, learned Advocate for the petitioner and Mr. Upendra Pratap Singh for the State.

For the petitioner having been made accused in a criminal case, his license was suspended. The petitioner claims that no notice has been served upon him for explaining his cause for restoration of his license. Since the matter has been taken up for the first time after its filing, there is no counter affidavit on record and therefore Mr. Upendra Pratap Singh is not in a position to inform this Court whether any notice has been served upon the petitioner intimating him that should his Patna High Court CWJC No.14726 of 2019 dt.02-01-2023

explanation be found to be unsatisfactory, his license shall be cancelled.

In any view of the matter, till date, no final order has been passed. Under the aforesaid circumstances, we direct that the petitioner be served with a show-cause notice within a period of thirty days of the receipt of a copy of this order by the licesing authority to which the petitioner shall reply within a further period of thirty days. The licensing authority shall, after adverting to the reply of the petitioner, pass a final order within a period of sixty days giving reasons in support of the decision so arrived at.

With the aforesaid direction/observation, the writ petition stands disposed of.
