Citation : 2023 Latest Caselaw 14 Patna
Judgement Date : 2 January, 2023

Patna High Court
Pama Devi vs The State Of Bihar on 2 January, 2023
          IN THE HIGH COURT OF JUDICATURE AT PATNA
                       Civil Writ Jurisdiction Case No.6788 of 2019
     ======================================================

Pama Devi, Wife of Sri Uday Kumar Singh, Resident of Village and Post - Basbitta, P.S. - Shambhuganj. District - Banka.

... ... Petitioner/s Versus

1. The State of Bihar through the Principal Secretary, Food and Consumer Protection Department, Old Secretariat, Patna.

2. The District Magistrate, Banka, District - Banka.

3. The Sub-Divisional Officer, Banka, District - Banka.

4. The Block Supply Officer, Shambhuganj, District - Banka.

... ... Respondent/s ====================================================== Appearance :

For the Petitioner/s : Mr. Rajeev Kumar Labh, Adv. For the Respondent/s : Mr. Anisul Haque, AC to AAG-5 ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR and HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL JUDGMENT (Per: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR) Date : 02-01-2023

Heard the learned counsel for the

parties.

2. The petitioner has come up with a Patna High Court CWJC No.6788 of 2019 dt.02-01-2023

queer prayer that the beneficiaries who have been

detached from the shop of the petitioner be again

tagged with his shop as his shop is left with lesser

number of targeted beneficiaries, which inures

neither in favour of the petitioner nor the

beneficiaries.

3. In any view of the matter, the

petitioner has not been able to make out any case

for us to interfere in this jurisdiction for the reason

that the central focus of the Bihar Targeted Public

Distribution System (Control) Order, 2016 is not

the licensee, but the targeted beneficiaries and we

do not find any complaint by any one of the

targeted beneficiaries who have been attached with

another P.D.S. shop.

4. Nonetheless, the counsel for the

petitioner, after some arguments, withdraws this

petition in order to, if so desired, agitate her cause

before the licensing authority. Patna High Court CWJC No.6788 of 2019 dt.02-01-2023

5. Disposed off as withdrawn with the

liberty aforesaid.
