Heard learned counsels for the respective parties.
2. In the instant writ petition, petitioner has prayed for
the following relief/reliefs:
"i. For quashing the disqualify order
dated 12.11.2022 and 06.04.2023 issued by the
respondents Executive Engineer, LAEO, Work Division
- 1 Motihari (East Champaran) who has disobeyed &
overlooked the order dt. 04.03.2023 of the
Superintendent Engineer, LAEO, Work Circle-
Muzaffarpur along with affidavit dt-17.08.2022 due to
his choice bidder.

ii. For restraining the respondents to allot
the work to his choice bidder till the disposal of the
writ who has quoted the highest rate in above tender.
iii. For direction may be given to issue the
work order to the petitioner (Lowest rate) as per order
of S. Engineer and NIT general conditions in the
public interest/revenue.
iv. For granting any other relief/s for
which the petitioner be found entitled in the eye of
law."
3. The petitioner has been disqualified for the subject
matter of bid pursuant to the NIT dated 28.07.2022, on the score
that his affidavit dated 17.08.2022 is not in terms of Sub clause
(vii) of 21 of NIT. There is no interim order staying further
proceedings in respect of subject matter of NIT. In other words, the
process of NIT has completed and third party right has been
created.
4. The petitioner has not assailed the award of contract
in favour of third party right during the pendency of the present
writ petition. No doubt, rejection of petitioner's application to the
extent that affidavit is not in terms of Sub clause (vii) of 21 of the
NIT. However, contents stated in the aforementioned Sub clause is
covered in the affidavit. In other words, it is not in the manner
indicated in the aforementioned Clause. It is necessary to
reproduce Sub clause (vii) of 21 of the NIT which reads as under:

5. The disqualification of the petitioner on a trivial issue
that affidavit filed by her in terms of the aforementioned Clause of
the NIT is not in the requisite format. It is to be noted that if the
affidavit is not in the format, on the other hand, the contents of the
affidavit meet the aforementioned Clause of NIT. Therefore,
rejection of the petitioner's bid or disqualifying him is a trivial
issue.
6. We could have entertained the petitioner's grievance
provided she had challenged the award of contract in favour of the
third party. That apart during pendency of the present writ petition,
third party must have executed the work. In the light of these facts
and circumstances, present writ petition stands disposed of as it
has become infructuous.
