Heard Ms. Binita Singh, learned SC 28 for the
petitioner-State.
2. As prayed for by learned counsel for the petitioner-
State, the defect(s) pointed out by the office be removed during
course of the day.

3. The petitioners seek recall of the order dated
20.09.2022 by which Civil Review No. 59 of 2018 stood
dismissed for non- prosecution.
4. Learned counsel for the petitioner-State submit that
the matter was being conducted by another learned State counsel
but due to inadvertence, nobody could appear on 20.09.2022
leading to dismissal of the case. It was submitted that the present
application has been filed on 28.09.2022 and thus there is no
deliberate laches on the part of the petitioners and the order be
recalled. Even on merits, it was submitted that the petitioner-State
has a good case.
5. Having considered the submissions of learned counsel
for the petitioner-State and upon going through the averments
made in the application, the order dated 20.09.2022 passed in Civil
Review No. 59 of 2018, stands recalled and the case is restored to
its original file and number.
