The matter has been heard via video
conferencing.
2. Heard the parties.
3. The grievance of the petitioners in the
present writ petition is that notwithstanding the huge
vacancies available in commerce stream, the
respondents are not conducting STET examination which
is the required condition for appointment of teachers.
4. Learned counsel appearing on behalf of the
Bihar School Examination Board would submits that the Patna High Court CWJC No.7387 of 2020 dt.24-06-2021
examination has been conducted and the result has
already been published. He submits that the examination
board is the only examining body and it can conduct
examination of any subject as directed by the State
Government.
5. Learned counsel appearing on behalf of the
State would submits that the State Government is
making necessary enquiry with regard to the
requirement of sanctioned post in commerce stream and
it shall take all necessary steps for holding teachers
eligibility test as soon as the requirement is ascertained.
6. Considering the aforesaid, the respondents
are directed to take all necessary formalities for
determining the vacancies in commerce stream within a
maximum period of three months from today and ensure
holding of the required eligibility test for appointment of
teachers of commerce stream within a maximum period
of six months from the date of receipt/production of a
copy of this order and thereafter take steps for Patna High Court CWJC No.7387 of 2020 dt.24-06-2021
appointment in accordance with law in the next selection
process.
7. With the aforesaid observation/direction, the
writ petition stands disposed off.
