                  JUDGMENT AND ORDER (ORAL)

1. In view of the order dated 27-05-2024, passed in MC[WP(C)]. No.

57 of 2024, Shri. Chandro Mohan Das is added as respondent No. 5.

2. Mr. R.H.Alice, learned counsel who is appearing for the newly

impleaded respondent No. 5 prays that he may be allowed to file affidavit.

However, on perusal of the affidavit filed by the State respondents that the

VEC elections will be conducted as per the Rules and Regulations of the

MGNREGS, this matter does not survive for consideration. The statement

on affidavit at paragraph 8 filed by the State respondents is reproduced

herein below:

"8. The Answering Respondent further begs to place further clarification on the fact that in regards to election/selection of VEC functionaries recently a complaint dated 04-03-

2024 has also been received to stop the selection of VEC functionaries and bifurcation of Sobribari VEC and requesting to conduct fresh election, and as the WP(C). No. 109 of 2023 has already been disposed the respondent can now conduct an election/selection as per the rules and regulations framed under MGNREGS."

3. Accordingly, this writ petition is disposed of with a direction that the

respondents conduct the elections within two months from today. The

newly impleaded respondent is at liberty to institute any proceeding if a

fresh cause of action arises.

4. With the above direction, writ petition is closed and stands disposed

of.
